What is GDPR

We believe it is important to comply with laws and regulations. In addition, we treat your privacy with respect and will do everything we can to protect your data.

The way we are expected to handle personal data is described in the GDPR. GDPR stands for “General Data Protection Regulation” and is a European regulation on data protection. This legislation ensures that companies (that collect, process, and use personal data) respect the privacy rights of individuals (customers and employees).

We, as Avis Budget Car Rental, are not a “Data Processor” but a “Data Controller.” This comes with responsibilities, which include taking at least the following measures:

Record-keeping obligation

Every company is required to document what personal data they receive, the purpose of the processing, and how long the data needs to be retained. To meet this obligation, we have drawn up a Record of Processing Activities, which we review and update periodically.

Privacy desk

Within our organization, we have a dedicated privacy desk that ensures the GDPR and our internal Privacy Policy are current and complied with. Our privacy desk can be reached via email at privacy@avis.nl. We audit our policy and locations on a regular basis to ensure both you and we continue to meet all requirements.

Measures to protect privacy

We have implemented appropriate security measures to protect personal data.

Data breaches

In the event of a data breach that may pose a risk to the individual involved, we are required to report it to the Dutch Data Protection Authority and the individual concerned within 72 hours of discovering the breach. We have outlined in our internal policy how our employees must act in the event of a data breach, in accordance with the guidelines of the Dutch Data Protection Authority.

Prior consultation and designing data processing activities

Under certain circumstances, we will consult the Dutch Data Protection Authority in advance of initiating a new high-risk data processing activity. In addition, we take privacy into account when designing and developing new products and services. Our existing products and services are also regularly reviewed to ensure that we only store data that is truly necessary. We also critically evaluate the retention period of this data.

By using our services (including our website, app, loyalty program, etc.), you agree to our Privacy Policy and the use of your data as described in this policy.

What does this mean for you?

As a customer, you have certain rights regarding the information you have provided to us and/or data we have collected over time.

We would like to inform you that if you have any complaints, you can contact our Customer Relations department (customer.relations@avis.nl).

We aim to resolve your complaint as effectively and quickly as possible. However, if your privacy-related complaint is not resolved to your satisfaction, you have the right to file a complaint with the Dutch Data Protection Authority (www.autoriteitpersoonsgegevens.nl).

What data do we process and why?

Reservation

To make a reservation or request a quote, we require at least the following information from you:

  • Gender
  • Initials and last name
  • Date of birth: your date of birth is necessary to determine whether you are old enough to drive one of our rental cars or the requested car class. Additionally, your age determines the level of the deductible.
  • Phone number: we ask for your phone number so we can contact you if we have any questions or need to discuss matters related to your reservation.
  • Email address: we need your email address to send you the reservation or quote.

Rental agreement

When you pick up the rental car and a rental agreement is created, we require the following information:

  • Gender
  • First and last name
  • Date of birth
  • Place of birth
  • Address details
  • Phone number: your phone number is only registered so our staff can contact you regarding your reservation or rental.
  • Email address: we use your email address to send you an invoice during or after your rental, or to contact you about matters related to your rental.
  • Driver’s license details: we need your driver’s license to verify your identity and confirm that you hold a valid license. We also use your license to check how long you’ve had it. We only rent to individuals who have held a valid driver’s license for at least one year.
  • Proof of address (if you live in the Netherlands): we may ask for confirmation of your home address to verify that you have a permanent address in the Netherlands. Only your first/last name and home address will be registered.
  • Passport or ID details (if you live abroad)
  • Local accommodation and/or flight details (copy of plane ticket) (if you live abroad)
  • International driver’s license (if your license is written in a non-Western script)
  • Payment details: if you pay by credit card, your credit card number will be partially anonymized. If you pay by debit card, your IBAN will be listed on the rental agreement in case we need to refund any remaining balance once your rental ends.

What data do we receive from third parties?

Most of the data is provided directly by you. In some cases, we receive data about you from third parties.

Travel agents, tour operators, brokers, and Avis Budget Group

If you book your reservation through a third party such as a travel agent, tour operator, or broker, we receive your data and travel itinerary as provided to them.

If you reserve a car via www.avis.com or another Avis reservation channel outside the Netherlands, we receive your details through Avis International.

Loyalty cards

Avis collaborates with various partners who offer loyalty cards to their customers. By presenting your loyalty card, you can collect points/miles and/or receive discounts. If you are collecting points/miles, we share your information with the relevant partner so they can add the correct amount of points to your account. You can find a list of our partners on our website: www.avis.nl.

If you have an Avis loyalty card or wish to apply for one, please note that these fall under the Privacy Policy of Avis Mobility Group. For more information, visit www.avis.com. When you provide us with your personal information to apply for a card or update your details, we are required to forward this data to Avis Mobility Group, where it will be processed.

Elena, the Car Rental Warning System (BOVAG)

Based on your information, we may receive a signal from the Car Rental Warning System operated by BOVAG. If this occurs, we cannot accept your reservation or rent a car to you. Our staff at the rental locations are not authorized to provide information about the reason for this alert.

For questions, you can contact our Security department (security@avis.nl). The Car Rental Members Association of BOVAG, PO Box 1100, 3980 DC Bunnik, is responsible for processing this data in the Car Rental Warning System. The personal data of the renter or driver will be recorded if the vehicle is not returned, if crimes or violations are committed with the vehicle, if the car is repeatedly damaged due to the renter's or driver’s actions or negligence, or if the rental fee is not paid on time or at all. You can request information about processed personal data and the registration period from BOVAG, and you may also submit a written objection.

Information Providers

We work with various information providers. An information provider assists companies in preventing fraud and managing credit risks. One of the tools we use in this context is the so-called ID Check Box. This device allows us to verify the authenticity of documents. If you are booking a vehicle as a private individual or self-employed person, your information may be checked using various databases made available to us by our information providers. For example, we may verify whether your name is linked to the provided address, whether the address has a history of involvement with bailiffs, etc. We need this additional information to determine whether we can rent a vehicle to you.

What data do we share with third parties?

Data Processing Agreement

We have a data processing agreement in place with all our partners and suppliers who act as “Processors.” This agreement outlines how your data should be handled. The most important condition is that your data is used solely for the purpose for which you provided it to us.

CJIB

If you receive a traffic fine during your rental, we may “waive” the fine. This means that we transfer your data (name, address, and rental details) to the CJIB, who will then send the fine directly to you. For municipal fines such as parking violations or local traffic infractions, the same data will be shared with the respective municipality.

We also provide access to a fine portal where you, as the driver, can view your fines. This portal includes the aforementioned data. To log in, you will need the license plate number, citation number, and your rental agreement number.

Damage

If damage occurs to the rental vehicle or you cause damage to a third party, we will share your details with our insurance company and, if applicable, the insurer of the other party.

If you're unable to continue driving the rental car, we will share your name, location, and phone number with a towing service to secure or transport the vehicle.

Payment Services

All bank and credit card transactions (both online and in-person) are processed through our payment partners. All transactions are handled in a secure and encrypted environment. We have a data processing agreement with each of these payment partners.

If you provide a credit card for deposit or payment, your data is shared with your credit card provider to process your payment—again, in a secure and protected environment.

Payment Reminders

If you still owe us an amount, we will send an invoice to the email address you provided. If we do not receive your payment within five working days, we will send you a reminder—potentially through one of our payment partners. This reminder will include a convenient payment link.

Debt Collection Agency

If payment is still not received after reminders, we are unfortunately forced to transfer your file to a debt collection agency. We work with several collection agencies who will contact you to make payment arrangements or initiate legal proceedings. The file we send them includes your rental agreement and invoice, which contain your personal data. When necessary, we may also share prior correspondence or phone call records.

Avis Budget Group

Avis Netherlands is a franchise business; our rental system and your data are not automatically shared with Avis Budget Group (the franchisor).

If you make a reservation with Avis Netherlands for a location abroad, your data (name, address, and date of birth) will be entered into the rental system of Avis Budget Group.

If you break down in one of our rental cars abroad and need a replacement vehicle, we are required to share your data with Avis Budget Group so they can arrange a new car for you.

Roadside Assistance

If you experience a breakdown or accident and can no longer drive the rental car, we will contact a roadside assistance provider. We work with several partners in this area and only share your name, phone number, location, and the license plate of the rented vehicle when necessary.

If you need a replacement vehicle, this will be arranged by one of our locations or external partners. These partners only receive the information necessary to get you back on the road.

Government Authorities

Your data may be shared with government authorities such as the police, emergency services, etc. In some cases, we are legally required to share this data and are not allowed to notify you. In other situations, we will only share your information with authorities if absolutely necessary (for example, in the event of an accident involving one of our rental vehicles).

Elena: Car Rental Warning System (BOVAG)

Your data may be included in the Car Rental Warning System. For more information, see the section “What data do we receive from third parties.”

Website

Our website is developed and maintained by a partner that specializes in building websites and e-commerce platforms. When you make a reservation on our website (www.avis.nl), we receive this data digitally via this partner. It is then uploaded to our Car Rental System.

Other

We reserve the right to engage partners and suppliers for reasons other than those listed. Your data will only be shared with them if it is strictly necessary and/or helps ensure a smooth rental process.

How do we handle your data?

Car Rental System

All the data mentioned above is registered in our Car Rental System and stored for a maximum of 7 years, in line with the statutory tax retention period.

Scanning

We scan your driver’s license, passport or ID card (if applicable), proof of address, and the rental agreement. These scans are stored in our Car Rental System.

When scanning your driver’s license, passport, or ID card, we use a masking tool to block sensitive information such as your citizen service number (BSN). Your photo ID is also scanned; if you object, you may cover your photo. To ensure that all our employees use this masking tool correctly, we regularly audit all our locations.

We retain scans of your driver’s license, passport or ID card, and proof of address for 4 months after your rental agreement ends. After this period, the scans are deleted from our Car Rental System.

Only our employees have access to your data. Our internal Privacy Policy outlines how they are expected to safeguard it.

The rental agreement (Part 1 of 2), the invoice, and the BPM form (if applicable) are retained for 7 years due to statutory tax obligations. After 7 years, these documents are securely destroyed using confidential document shredding: the papers are placed in a sealed container and are then shredded or incinerated.

All other documents are printed as little as possible and are typically sent to you by email. If printed, they are kept only until your rental agreement is fully processed and then shredded using a document shredder.

Newsletters and offers

We will never send you digital newsletters or promotions without your prior consent. These are only sent with your explicit permission.

If you wish to withdraw your consent, you can contact our Marketing department by sending an email to marketing@avis.nl.

Please note that if you unsubscribe from newsletters and offers, you may no longer be eligible to receive certain deals.

What happens when you delete your Avis account?

Deleting your online account comes with the following conditions: You will not be able to create a new online account using the same email address in the future.

You cannot delete your online account if you have an active reservation.

You will no longer be able to benefit from account perks like Avis Club.

Are you a member of Avis Club? If you delete your account, your Avis Club membership will automatically be canceled.

Please note that we are required to retain your rental data for 7 years due to tax regulations.

Reviews and User Contributions

When you leave a review on our website, you consent to the use of certain personal information and agree to the terms outlined below:

  • Your first name will be shown alongside your review on the website;
  • You confirm that the review reflects your own experience and that it does not infringe upon the rights of third parties, such as copyrights or privacy rights;
  • You grant Avis an irrevocable, worldwide, royalty-free, and non-exclusive license to use, edit, reproduce, and publish your review (including any submitted photos) in any format, including but not limited to our website, advertisements, social media, and email campaigns;
  • After verification, your review may be published on the Avis website and/or shared through external platforms like Google. Your email address will not be shared—only your review content and first name will be displayed;
  • Avis reserves the right to reject, edit, temporarily withhold, or remove reviews and/or photos, particularly if the content is discriminatory, offensive, factually incorrect, or in violation of house rules;
  • You indemnify Avis against any claims, costs, or damages arising from violations of these terms or applicable laws;
  • Your review may remain visible indefinitely unless you request its removal;
  • We store personal data such as your name, email address, and IP address in accordance with our Privacy Policy;
  • These terms of use, the House Rules, and the Privacy Policy are governed by Dutch law. Any disputes will be submitted exclusively to the competent court in the Netherlands.

CCTV Surveillance

All our locations are equipped with security cameras placed both inside and outside the premises. These cameras are solely used for the prevention and documentation of criminal activity.

Camera footage is stored for a maximum of 2 weeks before being automatically deleted, unless required by authorities, in which case it may be released.

Access and Data Portability

Especially if you rent from us regularly, we collect a considerable amount of information over time about your rental behavior—such as the number of kilometers driven, rental duration, etc. If you wish to access this information and/or need it for other purposes, we can share it with you in a commonly used file format.

If you would like to know what information we have on file and/or would like to receive a data file, please follow these steps:

Naturally, we can only share or modify data that personally relates to you and not about third parties. Therefore, we will ask you to verify your identity in person at one of our locations and to submit a fully completed form. You will receive our written response within 4 weeks.

If you would like to update your data, you can do so at one of our locations listed on www.avis.nl/vestigingen or by logging into your account at www.avis.nl. Please note: if you have an online Avis account, you must update your data online, as our locations are not able to do this for you.

Data we have received for processing a quote, reservation, and/or rental cannot be deleted due to our accounting and legal (tax) obligations.

Use of Rental Vehicles

Many of our rental vehicles are equipped with various systems and software such as navigation, Bluetooth, and hands-free kits. The use of these systems and software is the responsibility of the renter and/or drivers of the vehicle. Any data entered and devices connected to our vehicles must be removed by the renter and/or drivers before returning the car.

We reserve the right to equip vehicles with software that can track location, driving behavior, and vehicle data. This information will only be used in relation to your rental transaction or in cases of suspected misuse or excessive driving behavior.

Applying for a Job at Avis

Our website regularly features job openings to which interested candidates can apply by uploading and submitting a cover letter and resume.

These documents and any personal information provided will only be used to evaluate whether the candidate is suitable for a position at Avis. Your data will be handled confidentially and will not be shared with third parties (other than within our parent company, Spuigroep BV).

Please ensure that any references you provide are informed that their names and contact details have been shared.

Your CV and cover letter will be stored for a maximum of 1 year or 4 weeks if it is determined that you are not a match for any open position within our company.

Social Media

Avis uses social networks such as Facebook, Twitter, and LinkedIn. These platforms allow users to post public messages or comments on articles, news, or other posts. Please be aware that by posting a comment, all content, including personal or non-personal information associated with it, becomes public immediately and is subject to our Privacy Policy.

We reserve the right to remove any contribution or content at our discretion.
